Franxhi v Focus
Ms Franxhi secretly made 150 searches on the Internet over a four-day period in her search for a cheap holiday. All of the searches were carried out during working hours. Her dismissal was held to be fair.

Morse v Future Reality
Ms Morse shared an office with several men. A considerable amount of their time was spent in looking at sexually explicit material downloaded from the Internet. Although their discussions took place in the background and were not directed at her personally she felt uncomfortable, resigned and complained of sex discrimination. She was awarded compensation.

Company Policy
Companies should have a definite Internet policy in employee handbooks relation to staff specifying :-
  • Email should only be used in the conduct of the firm's business.
  • Email abuse can result in disciplinary action.
  • Permitted uses should be clearly set out.
  • All electronic communications remain the property of the Company.
  • The firm retains the right to access and retrieve all data during routine audits.
